Description of Promotion:

• This welcome promotion is a new member promotion welcoming players to Borgata in New Jersey (this “Promotion”).

Promotion Period:

• This Promotion runs from January 1, 00:01 EST 2024 through December 31, 23:59 EST 2024 (the “Promotional Period”), for new New Jersey account registrations.

Eligibility:

• New Borgata customers only – this offer is not applicable if you already have an existing Borgata online account in New Jersey.
• To be eligible, players must be 21 years of age or older and playing physically within the state of New Jersey, not be on an exclusion or self-exclusion list, and not otherwise be an Unauthorized Person (as defined in the Terms of Service).
• All personal and contact data associated to the player’s account must be verifiable.
• Employees, officers, directors, members, and representatives of BetMGM, LLC (“Sponsor”), its parent and affiliate companies, and any advertising agency or web company connected with Sponsor, as well as immediate family members (spouse, parents, siblings and children) and household members of each such person, are not eligible to participate in this Promotion. Sponsor reserves the right to verify the eligibility of all participants. Sponsor additionally reserves the right to refuse or otherwise restrict the eligibility of any individual to participate in this Promotion for any reason, in its sole discretion, including based on a participant’s wagering patterns or wagering history.
• Any individual with a Sponsor account on any product in one or more jurisdictions where Sponsor operates that has been involuntarily closed, suspended (including any accounts in cool-off status), or where such account has been marked as fraudulent, is ineligible to participate in, and/or receive a prize, for this Promotion even where such entrant may seek entry in this Promotion through an active account in another jurisdiction.

Action Required:

• Following successful first deposit (minimum of $10) onto Borgata Poker, player’s account will be credited with a release-restricted bonus to match the first deposit amount up to a maximum $1,000 in restricted bonus (“Deposit Match Bonus”). Deposit Match Bonus is released only when release-restrictions are met.
  • 100% of the amount deposited (minimum of $10) up to $1,000 in restricted bonus.
• Deposit Match Bonus is released in increments of 10% of the player’s first deposit. The increments are earned out at a rate of 12*(increment amount) in Borgata Rewards Points. For example, if player deposits $200, the Deposit Match Bonus is released in increments of $20. In order to release $20 Deposit Match Bonus, the player needs to earn 240 Borgata Rewards Points (“BRP”) within 120 days of the initial deposit. The released Deposit Match Bonus will be credited to player’s account and available for withdrawal.
• Following successful sign up for a Borgata account in New Jersey, the following items will also be credited directly to player’s account based on the amount of the initial deposit:
  • Deposits of $10 - $499 into the player’s account will be credited with $25 Tournament Tickets.
    • 1x $20 Tournament Tickets and 1x $5 Tournament Ticket.
  • Deposits of $500 - $999 into the player’s account will be credited with $50 Tournament Tickets.
    • 1x $20 Tournament Ticket, 2x $10 Tournament Tickets, and 2x $5 Tournament Tickets.
  • Deposit of $1000 into the player’s account will be credited with $75 Tournament Tickets.
    • 2x $20 Tournament Tickets, 3x $10 Tournament Tickets and 1x $5 Tournament Ticket
  • Minimum eligible deposit any player can make to earn Deposit Match Bonus is $10. Maximum eligible deposit any player can make to earn Deposit Match Bonus is $1,000. Any deposit made above this amount will only credit the player the maximum in $1,000 in release restricted Deposit Match Bonus.
  • Deposit Match Bonus Release: 10% increments of Deposit Match Bonus amount based on 12 times increment in earned Borgata Rewards Points. For example: $200 deposit is matched $200 Deposit Match Bonus. Deposit Match Bonus is released in increments of $20. In order to release $20 Deposit Match Bonus, player needs to earn 240 Borgata Rewards Points. Released bonus is credited to player’s account available for withdrawal.
  • These Terms and Conditions may be modified by Sponsor at any time by posting the modified terms on the relevant page(s) of the Sponsor’s website. We recommend participant revisits these Terms and Conditions regularly. By participant’s continued participation in this Promotion, participant accepts any such modified terms.

Claiming Promotional Offer:

• Register for a new online Borgata account in New Jersey. Must be a bona fide new account and Sponsor reserves the right to reject duplicate and fraudulent accounts.
• Deposit Match:
  • Sponsor will match participant’s first deposit (minimum of $10) 100% with release-restricted Deposit Match Bonus, up to $1,000.
  • Deposit Match Bonus will be credited to participant’s Borgata account automatically once a deposit is made.
  • This Promotion expires seven (7) days after creating a new verified account at Borgata.
  • Deposit Match Bonus is limited to one (1) redemption per real money account.
  • Deposit Match Bonus not released within 120 days of the initial deposit will be considered expired and forfeit.
• Tournament Ticket Restrictions:
  • $5 Tournament Tickets may be used for any $5 tournament.
  • $10 Tournament Tickets may be used for any $10 tournament.
  • $20 Tournament Tickets may be used for any $20 tournament.
  • Tournament Tickets expire fourteen (14) days from date of issue.

Registration Procedure:

• Sign up for a new New Jersey Borgata online account during the Promotional Period.
• Make a deposit and get a Deposit Match Bonus, in restricted bonus and Tournament Tickets.
• To Create a Borgata account, select “Register” and fill out the online registration form. Provide your first and last name, email, date of birth, account name and password, SSN, phone number, and address. You may be prompted to create two security questions. Please remember your security questions and answers as you may need them in the future if you forget your password.
• All information must be valid in order for the account to be verified. You cannot place a wager until your account is verified.

Limitations on Participation:

• Deposit Match Bonus release is based on players’ real money poker play. Real money poker play results in earning Borgata Rewards Points (BRP), which are used to release Deposit Match Bonus.
• BRP are subject at all times to the then-current terms and conditions of the Borgata Rewards program.

Wagering Requirements/Exclusions:

• Player must complete the wager requirements on the Deposit Match Bonus within 120 days of the initial deposit or the bonus will be considered expired, and any further play will not result in additional bonus being earned out.
• Bonus is released in 10% increments of Deposit Bonus amount based on a 12 times increment in earned Borgata Rewards Points. For example: a $200 deposit is matched $200 Deposit match bonus. Bonus is released in increments of $20, player needs to earn 240 Borgata Rewards Points to release the $20 bonus.

Order of Funds Used for Wagering:

• Release-restricted Deposit Match Bonuses are released in increments of 10% of the bonus amount and earned when a 12x multiple of BRP is earned by player based on cash game play.
• Released bonus is credited to player’s account and available for withdrawal.
• Tournament tickets expire fourteen (14) days from date of issue.

Eligible Games:

• All Poker cash games generating rake and all poker tournaments generating fees.

Restrictions on Withdrawal:

• The Deposit Match Bonus is a release restricted bonus. Released bonus after meeting wagering requirements is credited to player’s account and available for withdrawal.

Cancellation:

• New players to Borgata that do not wish to receive deposit matches, tournament tickets, or any other prize/bonus associated with the Poker Welcome Offer should wait more than 7 days from the date of account creation to make their first real money deposit.

A Force Majeure Event expressly includes (i) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which, together with any related strains, variants and mutations thereof and other similar infectious diseases, are collectively referred to herein as “COVID-19”), or (ii) action, order, regulation or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.
• Released Parties are not responsible for and shall not be liable for: (i) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in this Promotion; (ii) technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a participant’s ability to take part in this Promotion; (iii) unauthorized human intervention in any part of the entry process of this Promotion; (iv) technical or human error which may occur in the administration of this Promotion or the processing of entries; (v) late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, undeliverable, damaged or stolen entries or notices (including winner notifications, if applicable); (vi) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (vii) any printing, typographical, human, administrative or technical errors or omissions in any material associated with this Promotion; (viii) any injury, loss, costs, expenses or damages to persons or property (including, but not limited to, damage to any computer system or mobile device related to participation in, accessing or downloading information related to this Promotion) which may be caused, directly or indirectly, in whole or in part, from participant’s participation in this Promotion or any related activity; (ix) any illegal activity by participant or anyone acting in concert with participant; and/or (x) any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any persons.
• This Promotion is subject to all applicable federal, state, provincial, and local laws and regulations and is void where prohibited or restricted by law.
• Sponsor reserves the right to alter, discontinue or terminate this Promotion, or any aspect of it, at any time, with or without notice, in the event that the Promotion is not capable of running as planned, including without limitation if there has been any printing, production, distribution or other error in any promotion communication or on the platform, or where there has been any error in the preparation for or conduct of any promotion affecting the result of this Promotion or the number of participants or the value of claims.
• Sponsor reserves the right to suspend, change or cancel this Promotion in its entirety or exclude any individual or individuals from participation if it determines at its sole discretion that there is fraud or there are any irregularities or abuses occurring in connection with this Promotion.
• Upon request for cancellation, Sponsor will inform the player of the amount of unrestricted funds that will be returned upon cancellation and the value of restricted funds that will be removed from the participant’s Account. If the participant elects to proceed with cancellation, unrestricted funds remaining in a participant’s interactive gaming account will be returned in accordance with the terms and conditions.
